Q-I’m a Part Time Unit Professional. What contract covers me?

Q – I was just hired as a Part-Time Unit Professional by XYZ Community College. Does section 11.01 apply to me in the same way as it applies to my Full Time colleagues?
A – No. The provisions in sections 11.01 through 11.04 of the contract, do not apply to part-time Unit Professionals. Please read the section on Part-Time appointments.
All Purpose Paid Leave
Q-I’m a Part Time Unit Professional. Do I get paid sick leave?
A- Not under that name. However, if you worked a total of at least 225 hours in one or more day division units during the previous fiscal year (July 1-June 30), you receive 15 hours of All-purposed Paid Leave, often called APPL (pronounced “Apple”) Time.
How you use the leave is up to you. You can use it to cover absences due to sickness or other purposes including school holidays or for a mini vacation. If you worked more than 900 hours total in the previous year, you get 22.5 hours of all-purpose paid leave. To collect, you need to fill out a leave form and receive approval from your supervisor.
Q-Can I carry over All-Purpose Paid Leave from year to year.
A-No. All-Purpose Paid Leave must be used by the end of the fiscal year (June 30.)
Seniority
Q-Does longevity of service mean anything to a Part Time Professional?
A– Yes. Under the contract, the college is required to offer appointments to qualified Part Time Professionals based on seniority. To be credited with at least a half-year of seniority, you must work at least 225 hours. This is also the number of hours that you need to qualify for All-Purpose Paid Leave, so it is important.
Q-How do I know how much seniority I have?
A-The college must post a seniority list for Part Time Professionals annually. Once the list is posted, unit members have 30 days to report and challenge errors. The most frequent issue is a small variation in job title from contract to contract. For example, ESL Tutor and Online ESL Tutor. If the job is the same, the job title should be the same. Otherwise the unit member may lose APPL Time and seniority.
Evaluations
Q – What is the purpose of an evaluation?
A – According to Section 13.01 of the contract, the objective of an evaluation of unit members is to assess and improve performance and to provide a basis upon which further decisions such as re-appointments, promotion, performance-based salary adjustments, tenure, sabbatical, professional leaves and discipline might be made.
Q – I’m a Part Time Unit Professional. Do I have a form used for my evaluation?
A – Yes. You use the E10 form. This form is similar to the E8 form described above and used for the evaluation of full time Unit Professionals.
Q – As a Part Time Unit Professional, is the criteria the same for my evaluation as it is for my Full Time counterparts?
A Yes. You will be evaluated on job performance, College service, and advising, if it is applicable,
Q – May I contest a review that I disagree with?
A – You have the right to comment on the E-10 forms. There is a section where you can write your comments disagreeing with points made by the Evaluator, or even just commenting for whatever reason on what has been stated in your E-10

Q – I’m a Part Time Unit Professional. Do I have a form used for my evaluation?
A – Yes. You will use the E10 form. The E10 form covers the same criteria for evaluation that the E8 form does. It includes comments from the Evaluator (your supervisor) on your College Service, Student Advising or Recruitment (if applicable), and your Work Performance, your Personnel File. It usually includes an Overall Evaluation statement.
Q – If I disagree with what my Supervisor has written, do I have any recourse?
A – Yes. Like your Full-Time colleagues, you have the right to write a rebuttal for inclusion in your personnel file. There is a section on the form for Professional Staff’s comments. You can also attach a separate page if you chose. A copy of the E-8 will be placed into your Personnel File in your HR office. If you have a serious disagreement with your evaluation, consult with your Local MCCC leadership.
Discipline
Q – What if I get an evaluation that I don’t agree with, what can I do?
A – At the time of your evaluation, you have the right to write a rebuttal for inclusion in your personnel file. There is a section on bottom of the E10 form that allows for you to add your input.
Q – If I believe that my Supervisor wishes to speak with me for a job related issue that may compromise my rights what do I do?
A – You can ask for union representation at any meeting that you feel might become disciplinary. This falls under the Weingarten Rights. Also, see the FAQ section under Grievance.
You are allowed to bring union representation to any meeting that may involve disciplinary actions. (see Weingarten Rights.)
Workloads
Q – Is there anything in the contract about Part -Time Unit Professional Workloads?
A – Yes, and it is also a very general overview of workload, and does not describe specific tasks and the time needed to complete them. This description for Part-Time Unit Pros can be found in section 12.05 of the Contract.
